1. Definitions

Throughout these Terms of Service:

• "App" refers to the Art Inventory application
• "We," "Us," "Our" refers to Art Inventory LLC
• "You," "Your" refers to the individual using the App
• "Device" refers to your iPhone, iPad, or Mac

2. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Art Inventory on your Apple devices for personal or professional art management purposes.

You may:

• Download and use the App on multiple devices using your Apple ID
• Create, store, and manage artwork records
• Import and export your data
• Use the App for commercial art management purposes

You may not:

• Reverse engineer or attempt to extract the source code
• Modify, adapt, or create derivative works
• Resell, sublicense, or distribute the App
• Use the App for any illegal purposes
• Remove any proprietary notices or labels

3. Your Data

Data Ownership

You retain full ownership of all data you enter into Art Inventory, including:

• Artwork information and images
• Client and contact details
• Sales records and financial data
• Notes and documentation

Data Storage

All data is stored locally on your device. We do not have access to your data. You are responsible for:

• Maintaining backups of your data
• Ensuring data accuracy
• Protecting your device from unauthorized access

4. Intellectual Property

The App, including its design, features, and functionality, is owned by Art Inventory LLC and is protected by international copyright, trademark, and other intellectual property laws.

5. User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your device
• All activities that occur using the App on your device
• Ensuring your use complies with all applicable laws
• Backing up your data regularly
• Keeping your iOS/macOS updated for optimal performance

6. Disclaimer of Warranties

Art Inventory is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of information

7. Limitation of Liability

To the maximum extent permitted by law, Art Inventory LLC shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your device
• Damages resulting from any third-party actions

8. Data Accuracy and Professional Use

While Art Inventory is designed for professional use:

• We do not verify the accuracy of data you enter
• You are responsible for ensuring data accuracy
• The App should not be the sole record for legal or insurance purposes
• Always maintain physical documentation as required by law

9. Indemnification

You agree to indemnify and hold harmless Art Inventory LLC from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App or violation of these Terms.

10. Termination

These Terms remain in effect until terminated. You may terminate by deleting the App from all your devices. We may terminate or suspend your license immediately without notice if you fail to comply with these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.

12. Apple-Specific Terms

Additional terms for App Store distribution:

• These Terms are between you and Art Inventory LLC, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for any product warranties
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary with the right to enforce these Terms

13. Export Compliance

You may not use or export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
